Анотація
DNA profiling plays a critical part in identifying a person involved in
a crime. It also sheds light on ties such as genetic relationships between
distant populations, which could aid in criminal ancestry identification
and cross-border crime resolution. The study has a regulatory framework
governing the exchange of DNA between EU member-states under the Prüm
II Regulation. Given that the regulation facilitates the exchange of DNA
for law enforcement purposes, national law must ensure compliance. By
comparing the legal framework on this issue, the study highlights the need
for harmonization of databases for the efficient and secure exchange of DNA
data in criminal investigations.

On 25th of April 2024 came into force the
Regulation (EU) 2024/982 on the automated search and exchange of data
for police cooperation, and amending Council Decisions 2008/615/JHA and
2008/616/JHA and Regulations (EU) 2018/1726, (EU) No 2019/817 and
(EU) 2019/818, being initially published in the Official Journal of the EU on
5th of April 2024. Accordingly, Member States should, at the time of initial
connection to the router established by the Prüm II Regulation, conduct
automated searches of DNA profiles by comparing all the DNA profiles stored
in their databases with all the DNA profiles stored in all the other Member
States’ databases and Europol data. At the same time, when it is possible
to exchange genetic information, national databases use different software
systems for comparison (while the majority use CODIS, other countries
such as Germany, Austria, Denmark, France, Luxembourg, and the United
Kingdom, among others, use other systems).
