Successful execution of tasks in a criminal proceeding is significantly
influenced by various factors, with the actions of the prosecution playing
a pivotal role. It falls upon the prosecution to record information about
the committed criminal offense and the proof in a criminal proceeding.
Considering the complexity of these activities, particularly in categories
of criminal offenses involving preparation, direct commission, and
concealment, the Article Purpose is to clarify typical grounds for commencing
a criminal proceeding. It focuses on acts related to the unlawful acquisition
and seizure of property and assets belonging to enterprises, institutions,
and organizations. What is more, it aims to address identified problematic
issues that arise after a criminal offense is registered and to establish
typical organizational and legal forms for the prosecution’s activities during
this stage of criminal procedural activity. After theoretical analysis and
generalizing empirical data, it has been determined that the prosecution’s
activity at the beginning of a criminal proceeding related to raiding occurs
in two distinct organizational and legal forms: initiative and functional
(protocol). Additionally, several other provisions have been substantiated.
